User has access to consumer reports, defined as
ANY report used to determine an individual’s eligibility, as
outlined in the Fair Credit Reporting Act (FCRA), which includes employment
(pre-employment, promotion, reassignment, and periodic background
checks), tenant screening, and use in connection with a financial
transaction/extension of credit or the underwriting of insurance.

Requesting a Consumer Report and/or Investigative
Consumer Report for Employment Purposes.
User agrees that a consumer report for employment purposes will not
be requested unless:
- A clear and conspicuous disclosure
has been made in writing to the consumer before the report is obtained,
in a document that consists of the disclosure that a consumer report
may be obtained for employment purposes.
- The consumer has authorized
in writing the procurement of the report.
- If an Investigative Consumer
Report is requested, the consumer must be notified in writing not
later than three days of requesting said report.
- A Consumer Summary of Rights must be provided in the format approved
by the Federal Trade Commission. DrivingRecords.com, Inc will provide
an initial copy.
- The consumer has the right to request the nature and scope of
the investigation and the employer must respond in writing not later
than five days after receiving the consumers request or from the
date the investigation was first requested, whichever is the later.
- Requirements upon an Adverse Action/Decision User agrees that before
taking adverse action due to contents in whole or part of the Consumer
Report, it will provide to the consumer:
- A copy of the Consumer Report.
- A copy of the Summary of
Consumer rights in the format approved by the Federal Trade Commission.
An initial copy of the summary will be provided by DrivingRecords.com,
Inc.
- Adverse Action Notification:
- Must be in written, oral or electronic form.
- Must contain DrivingRecords.com, Inc’s name, address
and phone number.
- Must advise the consumer of his/her right to obtain a free
copy of the report within 60 days of the adverse action and
to dispute the accuracy or completeness of the report.
- User acknowledges that this entire procedure must be repeated before
future reports on the individual are requested.
- User will hold the contents of the consumer report in strict confidence
and use information only for purposes outlined in the disclosure.
- Failure to comply with FCRA requirements can result in state or federal
enforcement actions, as well as private lawsuits. (Section 606, 617,
621). In addition, any person who knowingly and willfully obtains a
consumer report under false pretenses may face criminal prosecution.
(Section 619).

DrivingRecords.com, Inc Further "user" agrees to release and
indemnify DrivingRecords.com, Inc or any of their information suppliers,
their parent, sister, and affiliate entities as well as officers, employees,
contractors, and agents from all liability arising from any unauthorized
access, improper use, or reliance on any of the information or data
we provide pursuant to this agreement. Any service or data provided
hereto by DrivingRecords.com, Inc to any client / customer is solely
exchanged on a strictly "As-Is" basis with no promise as to
any of the information gathered and provided to be relevant, accurate
or its performance or fitness of data is neither expressed nor implied.
- User hereby agrees that by using our website you waive up your legal
rights to sue us in any court of law. User agrees that he or she will
not hold company liable for any loss of employment, wages, medical,
or demand any form of compensation for any sort of loss either monetarily,
mentally, physically, or anything negative resulting from the business
exchange between you and company or to any entity authorized in obtaining
any disclosed data provided to you from company whether directly or
in-directly of receiving any information by us or any of our affiliates.
User understands and accepts that DrivingRecords.com, Inc is a private
corporation and any and all forms of arbitration can only be resolved
through “company” directly and will fall outside of any
governing laws within the State of California or Canada. By agreeing
to using our services and / or products or obtaining any information
from “company” via website, fax, telephone, or any other
possible means either verbal or non-verbal user you fully understand
and willingly accept these terms and abide by them.
